1. Introduction

This User Agreement is the contract between you and Nicu Adrian Ionita … trading as nixomarket, a sole trader in the United Kingdom, 10 Denham Green Lane , UB9 5LD, phone +447435344589 ("we", "us"), the operator of nixomarket (https://nixomarket.com). It applies to everyone who uses the site: visitors, buyers and sellers, individuals and businesses. By creating an account or using the site you agree to it.

These documents are part of it: the Privacy Policy, the Cookie Policy, the Fees pages, the Plan terms (paid plans, extra listings and upgrades) and the Refund & Cancellation Policy. Our design and marketing services are explained in section 20; website design work is also covered by its own written agreement (see Website design).

Contact: contact@nixomarket.com. As required by the Electronic Commerce (EC Directive) Regulations 2002, our name, address and email are given above.

In simple terms: this page is the set of rules for using the site, and it tells you who runs it and how to reach us.

2. About the marketplace

nixomarket is an online marketplace and classified ads site where individuals and businesses across the United Kingdom and Europe publish ads for items, services, rentals and jobs, and buyers contact them.

  • We are not a party to sales between users. The contract for an item or service is made directly between the buyer and the seller. We do not own, inspect, store or deliver the items, and we are not an auctioneer or an agent of either side.
  • With Buy now, the buyer pays by card on the site and the money goes straight to the seller's own Stripe account. The seller is the merchant of record. We never hold the money.
  • With other payment methods (cash, bank transfer, PayPal or a seller's own card link), the buyer pays the seller directly, outside the site.
  • We check new ads before they go live and we can remove ads, but we cannot guarantee that every ad is accurate, legal or that a seller will complete a sale.
In simple terms: we run the place where buyers and sellers meet; the deal itself is between them.

3. Using the marketplace

To use nixomarket you must:

  • be at least 18 years old and able to make a legally binding contract;
  • give true, complete information, and keep it up to date (company accounts must give the correct company name and, where they have one, VAT and registration numbers);
  • keep your password secret and not share or sell your account; you are responsible for what happens on your account;
  • only list items and services you are allowed to sell, in the right category, at a real price;
  • not sell counterfeit goods, or anything that breaks someone else's copyright, trade mark or other rights;
  • not post anything illegal, misleading, offensive, discriminatory or spam, and not manipulate prices, reviews or search results;
  • not copy, scrape or collect ads or users' details with robots or other automatic means, and not interfere with how the site works;
  • use other members' contact details only to discuss and complete the deal you contacted them about, never for marketing or spam;
  • not use the site to pay or ask for money for anything other than a genuine deal, and not ask for passwords, card numbers or identity documents in messages.

4. Misuse, and what we can do about it

If we believe that someone breaks this agreement, the law or the rights of others, or puts other users at risk, we may, depending on how serious it is:

  • refuse, edit (for example to fix the category) or remove ads, and hold new ads for checking;
  • limit, suspend or close an account, and cancel ads that are online;
  • block email addresses or internet (IP) addresses from contacting us or registering (see "Spam protection" in the Privacy Policy);
  • keep messages that look like spam for checking, and report illegal activity to the police or other authorities.

When we restrict your account or remove your content, we tell you the reason by notification or email, unless the law or the safety of others stops us. You can appeal (section 7). If we close an account for a serious breach, paid plans, extra listings and upgrades are not refunded (see the Plan terms).

Contact details in messages. To protect members from scams, we may hide sellers' phone numbers on ads and automatically stop messages between members that contain a phone number, an email address or a link to a chat app. The sender sees a notice and can write the message again without it. Please talk and pay on the site, where problems can be reported to us.

In simple terms: if someone breaks the rules we can remove their ads or block them, and we will tell them why.

5. Protecting children

nixomarket is for adults only. Ads must not be aimed at children or show them in an unsafe or sexual way, and items that the law says cannot be sold to children (for example alcohol, tobacco, knives) must only be sold in line with that law. If we find material that may harm a child, we remove it at once, close the account and report it to the relevant authorities. If you see anything like this, use Report this ad or contact us straight away.

6. Illegal and harmful content, and how to report it

  • Every ad has a Report this ad button, and members can report messages as spam or abuse. Anyone can also write to us on the Contact page. Tell us what is wrong and, if you can, why it is illegal or harmful.
  • We look at every report, act quickly, and tell the person who reported it what we decided when we have their contact details.
  • We take these steps to meet our duties under the Online Safety Act 2023 (UK) and, for users in the European Union, the notice-and-action and statement-of-reasons rules of the Digital Services Act (Regulation (EU) 2022/2065).
  • If you think an ad breaks your intellectual property rights, write to us with the link to the ad, the right you hold and proof that you hold it.
In simple terms: if you see something illegal or harmful, report it with the button or the contact form; we check every report.

7. Appeals

If we removed your ad, restricted or closed your account, or did not act on your report, you can ask us to look again. Write to us on the Contact page within 6 months of our decision, saying what you disagree with and why. Appeals are free. Someone who was not involved in the first decision reviews it when possible, and we tell you the outcome and our reasons. This does not affect your right to go to court, or for users in the EU to use a certified out-of-court dispute settlement body.

8. Plans and fees

  • Creating an account, browsing, sending messages and buying are free of charge. Sellers can post ads within the limit of their plan (Free, Silver, Gold, Premium or Platinum) without paying per ad.
  • Paid plans, extra listings and listing upgrades (Featured, Highlight and Bump) are optional. Extra listings and listing upgrades are explained on the Fees pages, and the rules for buying, renewing and cancelling them are in the Plan terms. Buy now sales carry a commission on the item price, shown on the Fees pages.
  • Every price is shown before you pay. We give at least 30 days' notice on the site and by email before a change to our fees affects members; new prices apply only to purchases made after the change, and a subscription you already have keeps the price it started with. If you do not accept a change, you can close your account at any time.
  • You can cancel a subscription at any time with Cancel subscription in My account → My plan: nothing more is charged and the plan stays active until the end of the period already paid, without a refund of that period.
  • If you are a consumer, you have the right to cancel a purchase within 14 days under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013. Because you ask for a plan or an upgrade to start straight away, the refund is the price minus what you have already used, as explained in the Refund & Cancellation Policy.
In simple terms: using the site is free; you only pay for extras you choose, prices are always shown first, and you can stop a subscription whenever you like.

9. Listing conditions

  • As a seller you are responsible for your ads: that the item or service exists, is described honestly (condition, faults, photos you have the right to use), has a real price, and can legally be sold and delivered. You are responsible for any tax that applies to your sales.
  • Businesses that sell to consumers must follow consumer law, including giving their business identity and address, the information rules for distance sales and the 14-day cancellation right, and the Consumer Rights Act 2015 (goods must be as described, of satisfactory quality and fit for purpose).
  • Individuals who want to sell items must first pass our identity check (a photo of an identity document and a recent proof of address); companies are checked against the official company registers before they show the Verified badge. We may refuse or suspend sellers we cannot verify.
  • Ads stay online for a set number of days and can be renewed. Our team checks new ads and may edit or remove them.
  • How ads are ordered. In search results, ads with a paid or included Featured upgrade come first, then the newest ads; a Bump counts as a new posting date. You can also sort by price. The home page shows a row of Featured ads in turn and the newest ads. Featured ads always carry a "Featured" label. Some ads posted by our team, and ads of Platinum members, link to Amazon as affiliate links and are labelled "Ad · Amazon" (see the Affiliate disclosure).
  • Business seller information. The ads of company accounts show the business name, address, phone number, the email the company chose for buyers, and its registration and VAT numbers, so buyers know who they are dealing with.
  • Tax reporting of sellers. UK law (the Platform Operators (Due Diligence and Reporting Requirements) Regulations 2023) and the EU rules known as DAC7 ask online marketplaces to report to the tax authority, once a year, the sellers who in a calendar year make 30 or more sales of goods or are paid more than €2,000 (about £1,700) through the marketplace. We therefore count, for each seller, the sales paid with Buy now and the items marked as sold to a buyer from nixomarket; when you mark an item as sold you tell us honestly whether it sold through nixomarket and for how much. If you get close to these limits we will ask you for your full name, date of birth, home address and National Insurance or tax identification number (for a business: legal name, address and registration or tax number, and VAT number if you have one). You must give correct details and keep them up to date. If you reach the limits and do not give them, we may stop you from posting new ads until you do. After the end of the year we send HMRC a summary of your sales with these details, HMRC may share it with the tax authority of the EU country where you live, and we give you a copy of what we sent. Being reported does not by itself mean you owe tax; you remain responsible for your own tax. See HMRC's guide for online sellers.

10. Buying conditions

  • Read the whole ad and ask the seller about anything that is not clear before you pay. Agree the price, the delivery and how you pay in a message.
  • When you pay with Buy now, you make a binding purchase from the seller. The seller then sends the item and gives the courier and tracking number.
  • Returns, cancellations and refunds of items are handled by the seller. When you buy from a business at a distance, you normally have 14 days to cancel and the protection of the Consumer Rights Act 2015 (or your country's consumer law). When you buy from a private person, these consumer rights do not apply in the same way, but the item must still be as described.
  • nixomarket does not offer its own money-back guarantee. Card payments may give you chargeback rights through your card issuer, and PayPal may offer its own buyer protection under its terms. Read our Safety tips.

10a. Auctions

  • When auctions are available, a seller who can take card payments with Buy now may sell an item by auction instead of at a fixed price. The seller sets a starting price, how many days the auction lasts and, if they want, a reserve price: the lowest price they accept. Buyers do not see the reserve price, only whether it was reached.
  • To bid you need an account. You enter the most you are willing to pay; we then bid for you automatically, one step at a time, only as much as needed to keep you in the lead, up to your limit. The current price, the number of bids and the time left are shown on the ad. Other bidders are shown with masked names, and the leader's limit is never shown.
  • A bid is a binding offer to buy. You cannot withdraw it yourself; if you made a mistake, contact us straight away and we may remove it while the auction runs. Sellers must not bid on their own items or ask others to do so, and nobody may bid only to push the price up. We remove such bids and may suspend the accounts involved.
  • A bid in the last minutes of an auction moves its end a few minutes later, so that other bidders can answer.
  • When the time is up, the highest bidder wins if the reserve price (if any) was reached, and a contract of sale is made between the seller and the winner at the final price. The winner must pay with Buy now within the time shown on the ad (normally 48 hours); delivery costs set by the seller are added. If the winner does not pay in time, the item is no longer reserved for them. The seller may then offer it to the next bidder at that bidder's highest bid, or start the auction again. An offer to the next bidder does not bind them: they buy only if they pay.
  • Once someone has bid, the seller cannot change the starting price, the reserve price or the length, and cannot end the auction early. We may stop an auction that breaks these terms; its bids then no longer count.
  • Your consumer rights are the same as for any purchase made at a distance (section 10). An auction on nixomarket is an online sale, not a public auction attended in person, so when you win an item from a business seller you keep the 14-day right to cancel and your rights under the Consumer Rights Act 2015 (or your country's consumer law). When you buy from an individual, the item must still be as described.
  • nixomarket is not the seller and does not take part in the bidding: we provide the platform, and Stripe processes the payment for the seller. The Buy now commission, paid by the seller, applies to the winning price, never to the delivery cost.

In simple terms: bid only what you are happy to pay, because if you win you must buy it and pay within the time shown.

11. The UK and Europe only

nixomarket is for sellers and buyers in the United Kingdom and Europe only, in pounds and euros. We do not offer the service in other parts of the world. Sellers arrange delivery themselves, choose the courier and send the tracking number; parcels between the EU and the UK (or other non-EU countries) go through customs, and the buyer may have to pay import VAT or duty. See Shipping and delivery.

12. Your content and our licence to use it

You keep ownership of the text and photos you post. You give us a non-exclusive, free licence to store, show, adapt (for example resize photos) and share them only to run and promote nixomarket: on the site, in emails to members and, when it is switched on, in automatic posts of live ads on our Facebook Page and Instagram account. The licence ends when you delete the ad or your account, except for copies in backups for a short time and posts already published, which we remove if you ask. You confirm that you have the right to the content you post. We do not sell your content or build a product catalogue from it for others.

13. Data protection

We handle personal data under the UK GDPR, the Data Protection Act 2018 and, for people in the EU, the EU GDPR, as explained in the Privacy Policy. When a buyer and a seller exchange details (name, address, phone, email) to complete a deal, each of them becomes responsible for that data in their own right: use it only for that deal and keep it safe. Businesses must follow data protection law towards their customers.

14. Payments

  • Buy now payments are processed by Stripe for the seller (Stripe Connect). Sellers must accept the Stripe Connected Account Agreement; Stripe charges them its own processing fees, and our commission is taken automatically from each Buy now payment. When a seller refunds a sale, our commission is returned in proportion.
  • Payments by cash, bank transfer, PayPal or a seller's own card link go directly from the buyer to the seller. nixomarket does not receive, hold or refund this money and is not a payment or escrow service.
  • Payments to us (plans, extra listings, upgrades) are made by card through Stripe, by PayPal or by bank transfer, as offered. We never see or store your full card number.

15. The AI help assistant

The help chat on the site may be answered by an AI assistant. Its answers are written automatically from information about the site and can be incomplete or wrong; they are not legal, tax or financial advice, and they do not change this agreement or our prices. If in doubt, ask for a person in the chat or contact us. How chats are kept is explained in the Privacy Policy.

16. Liability

  • Nothing in this agreement limits our liability for death or personal injury caused by our negligence, for fraud, or for anything else the law does not allow us to limit. Your statutory rights as a consumer are not affected.
  • We are responsible for loss you suffer that is a foreseeable result of us breaking this agreement or not using reasonable care and skill. We are not responsible for loss that was not foreseeable.
  • Because sales are between users, we are not responsible for the items or services in ads, for what users say or do, or for whether a deal is completed, unless the loss is caused by our own breach or negligence.
  • We work to keep the site available and safe, but it may sometimes be unavailable for maintenance or reasons outside our control.
  • If you use the site for your business, we are not liable for loss of profit, business or opportunity, and our total liability to you in any 12 months is limited to the higher of the fees you paid us in that period and £100.
In simple terms: we take responsibility for our own mistakes as the law requires, but not for what other users sell or do.

17. Compensation

If you use the site for your business and someone makes a claim against us because of your ads, your content or your breach of this agreement or the law, you will cover the reasonable costs and losses this causes us. If you are a consumer, this applies only as far as the law allows.

18. Disputes and the law that applies

  • If you have a problem with us, please contact us first: most things can be solved quickly. Problems with a purchase should first be raised with the seller.
  • This agreement is governed by the law of England and Wales, and the courts of England and Wales can hear disputes. If you live in Scotland or Northern Ireland, you can also go to your local courts.
  • If you are a consumer living in the European Union, you also keep the protection of the mandatory consumer laws of your country, and you can bring a claim in the courts of the country where you live.
In simple terms: talk to us first; English law applies, but consumers keep the protection of the law and courts of the country where they live.

19. General

  • We may update this agreement, for example when the site or the law changes. We tell members about important changes by email or on the site at least 30 days before they apply, unless a change is needed sooner for legal or safety reasons. The date at the top shows the latest version; the previous version stays available.
  • If a court finds part of this agreement invalid, the rest still applies.
  • If we do not enforce a right straight away, we can still enforce it later.
  • Under the Contracts (Rights of Third Parties) Act 1999, nobody other than you and us can enforce this agreement.
  • You may not transfer your account or this agreement to someone else. We may transfer it to a business that takes over nixomarket, and we will tell you.
  • We send notices to the email address on your account or show them in your notifications. Send yours to contact@nixomarket.com.

20. Design and marketing services

Besides the marketplace, we offer services for businesses and individuals. They are separate from buying and selling on nixomarket.

  • Design: websites (one-page websites, small business websites, business websites, booking websites, online shops, marketplaces and platforms), the redesign of an existing website, logo design, and hosting support, updates and website maintenance.
  • Marketing: promo video clips for social media and ads, SEO setup (Google Search Console, Google Business profile and speed), texts written for your website, and advertising on nixomarket.

How these services work:

  • Prices on our Website design and Promo videos pages are guide prices. We confirm the final price and what is included in writing before we start.
  • For a website, an agreement with the price, the payment stages and the cancellation terms is created automatically when you send your request, and we email you a copy. For promo videos and other marketing work, your request and the quote we confirm by email form the agreement.
  • You must own, or have the right to use, the photos, logos, texts and other material you send us. You are responsible if they break someone else's rights.
  • We do our best for your business, but we cannot promise results such as a position in Google, a number of visitors, followers, enquiries or sales. Google, Facebook, Instagram, TikTok, YouTube and other platforms have their own rules and may refuse or limit content or ads.
  • We do not sell hosting or domains: you buy them in your own name, from a provider of your choice.
  • After we deliver a website, errors in the work we delivered are fixed free of charge for 30 days (60 days for large projects), even without a maintenance plan, as set out in the website agreement.
  • Cancelling and refunds are explained in section 1 of our Refund & Cancellation Policy.
In simple terms: you get a written price before we start, the material you send must be yours to use, and nobody can guarantee marketing results.
